Terms & Conditions – Christmas Lighting Services

LawnSavers Plant Health Care Inc. (“LSPHC”)
also DBA “Christmaslightstoronto.com”
LawnSavers Plant Health Care Inc. (LSPHC) takes the utmost care and precaution to protect your premises and property during all Christmas lighting installation and takedown services. These Terms & Conditions form a binding agreement between LSPHC and the customer identified in the associated proposal or work order.
By accepting service, the customer agrees to the Terms & Conditions outlined herein by LawnSavers Plant Health Care Inc., operating as Christmaslightstoronto.com.
1. Authorization and Access
Customer hereby authorizes LSPHC and its employees, contractors, and representatives to access and work on the property for the purposes of installation and takedown of seasonal lighting and decorations. This includes the use of ladders, roof anchors, safety equipment, and other tools as deemed necessary to perform the services safely.
Customer agrees to provide free, clear, and safe access to all required areas of the property, including access to functioning exterior power sources in close proximity to installation areas.
2. Design and Aesthetic Expectations
Lighting design is subjective and trees, shrubs, and architectural features vary in size and shape. Installations will be completed on a best-efforts basis using the agreed number of lights and materials to meet the spirit of the design plan.
Additional lighting, modifications, or redesigns requested by the customer after installation may be provided at an additional charge, subject to availability and scheduling.
3. Ownership and Use of Materials
All lighting, décor, and related equipment remain the sole property of LSPHC until payment has been received in full. Unauthorized removal, modification, or relocation of these materials is strictly prohibited. Customers are expressly prohibited from attempting to install, move, or modify LSPHC’s materials themselves, and LSPHC accepts no liability for damages or injuries resulting from such actions.
4. Payment Terms
By signing this agreement, the customer authorizes LSPHC to charge the deposit to the credit card provided and acknowledges that the remaining balance will be automatically charged at the time of installation.
- Contracts not paid in full within 7 days of installation will incur a 10% late fee.
- Interest will accrue on overdue balances at 2% per month (24% per annum).
- If full payment is not received, LSPHC reserves the right to retrieve all materials from the property, with prior notice, and the customer hereby grants permission for such retrieval.
- Retrieval shall be conducted peaceably and during reasonable hours.
- Failure to pay does not release the customer from the total contract amount; LSPHC reserves the right to pursue collection of the full contract value and associated legal or recovery costs.
5. Service Calls and Warranty
Service calls for issues not caused by installation error (including wind, snow load, freezing rain, ice, animal interference, vandalism, or other environmental conditions) will be charged at:
- $110 + HST for the first 30 minutes
- $95 + HST per hour thereafter
- Plus applicable materials cost
Seasonal lighting is approved for up to 90 days of exterior use per year, in accordance with TSSA, UL, and CSA certifications. LSPHC is not responsible for damage or failure due to prolonged exposure, electrical issues, vandalism, animal activity, or severe weather events. These occurrences are not covered under warranty. Rain or moisture from fog, snow & ice may affect the ability of lights to function fully and properly.
6. Assumption of Risk
Customer acknowledges that outdoor installation and takedown of lighting involves inherent risks, including minor damage to roofing materials, gutters, fascia, paint, siding, trees, and landscaping. The customer assumes these risks, except where damage results from the gross negligence or willful misconduct of LSPHC.
Customers are advised to use extreme caution around wires, cords, and decorations, which may present a tripping or safety hazard. LSPHC is not responsible for any injuries sustained due to misuse or failure to observe safety warnings.
7. Force Majeure
No party shall be liable for failure or delay in performance where such failure arises due to causes beyond its reasonable control, including but not limited to:
- Natural disasters (wind, ice, flood, earthquake, etc.)
- Extreme weather conditions
- Labour disputes or shortages
- Material or supply shortages
- Power outages or utility failures
- Transportation delays
- Government orders or public health restrictions
These events shall not entitle the customer to cancel the contract or claim damages.
8. Insurance & Certifications
LSPHC carries:
- $5,000,000 Commercial General Liability Insurance
- WSIB coverage for all employees
- Working at Heights Certification
9. Storage Terms
Storage of materials is included until October 1st of the following year. After that date:
- Storage is available for $85 + HST per item (box, wreath, etc.)
- Items not claimed within 60 days of the end of the storage term will be considered abandoned, and LSPHC may dispose of them without further notice.
10. Limitation of Liability
Notwithstanding anything to the contrary in this agreement, LSPHC, its contractors, and successors shall not be liable for any special, indirect, consequential, or incidental damages, including loss of use, loss of enjoyment, business interruption, or lost profits, even if advised of the possibility of such damages.
Liability for any damages arising from the services provided shall be strictly limited to the amount paid under this agreement.
11. Indemnification
Customer agrees to indemnify, defend, and hold harmless LSPHC, its officers, employees, contractors, and agents from and against all claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- Injury or damage to third parties
- Customer misuse or alteration of installed materials
- Inadequate or faulty customer-owned electrical wiring or equipment
- Any unauthorized installation or interference by the customer or a third party
12. Survival of Terms
Any provisions of this agreement that by their nature are intended to survive termination — including but not limited to indemnity, limitations of liability, and payment obligations — shall remain in full force and effect after the end of the service relationship.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
14. Entire Agreement
This Agreement constitutes the entire understanding between the parties with respect to the subject matter and supersedes all prior agreements or representations, whether oral or written.
15. Modification and Waiver
No modification or amendment to this Agreement shall be binding unless made in writing and signed by both parties. No waiver of any provision shall be deemed a waiver of any other provision or of any subsequent breach.
16. Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Modifications to Terms
LSPHC reserves the right to update or modify these Terms & Conditions at any time to reflect changes in industry regulations, service offerings, or business practices. Any updates will be posted at https://lawnsavers.com/lighting-terms-of-service and will be effective upon posting.
Customers will be notified of material changes via email, phone, or seasonal communications. Continued use of our services after such notice constitutes acceptance of the updated Terms.

By agreeing to service, I acknowledge that I have read, understood, and agree to be bound by the Terms & Conditions above.
